TERMS OF SERVICE

1. Acceptance of Terms

By connecting to and using Hurtun Games ("we," "our," "us"), a Minecraft: Bedrock Edition practice server, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

2. Service Description

Hurtun Games is a Minecraft: Bedrock Edition server providing practice and gameplay features including, but not limited to: PvP practice, minigames, custom cosmetics, and community events. The service is provided "as is" and may be modified, suspended, or discontinued at any time without notice.

3. Eligibility & Age Requirements

  • You must be at least 13 years of age to use our services.
  • If you are between 13 and 18 (or the age of legal majority in your jurisdiction), you confirm that you have parental or guardian permission to use our server.
  • By using our service, you represent that you meet these requirements.

4. User Conduct & Server Rules

You agree to abide by all server rules posted in-game and on our website. The following behaviors are strictly prohibited:

  • Cheating/Hacking:Use of any unauthorized clients, mods, exploits, or third-party software that provides an unfair advantage.
  • Harassment: Hate speech, bullying, threats, or abusive behavior toward other players or staff.
  • Spam/Flood: Excessive messaging, advertising, or disrupting server chat.
  • Impersonation: Pretending to be server staff, other players, or affiliated parties.
  • Exploiting Bugs: Intentionally using game bugs or glitches for advantage.

Violations may result in warnings, temporary bans, or permanent bans at our sole discretion.

5. Account Responsibility

You are responsible for all activity under your Xbox Live/GamerTag account. Keep your account secure and do not share login credentials. We are not responsible for unauthorized access to your account.

6. Purchases & Virtual Items

  • License: Purchases grant you digital items for use and trading on the server. These items are non-refundable and cannot be redeemed for cash from Hurtun Games. We are not responsible for an item's "market value" or any losses during player-to-player trades.
  • All Sales Final: All purchases are final and non-refundable.
  • No Guarantees: We do not guarantee the availability of any specific item, rank, or feature.
  • Modifications: We reserve the right to modify, remove, or replace any virtual item at any time.

7. Intellectual Property

  • The server name "Hurtun" and associated branding are our intellectual property.
  • You retain ownership of content you create on our server, but grant us a license to use, modify, and display it.
  • Minecraft content is subject to Mojang's End User License Agreement (EULA). By using our server, you agree to comply with the Minecraft EULA.

8. Network & Connectivity

  • You acknowledge that Minecraft: Bedrock Edition servers require an internet connection.
  • We are not responsible for lag, disconnections, or gameplay issues caused by your internet service provider, network latency, or your device.
  • We may implement connection limits, queue systems, or maintenance windows as needed.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HURTUN GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US, IF ANY. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hurtun Games, its owners, operators, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these terms, your conduct on the server, or your infringement of any third-party rights.

12. Termination

We reserve the right to suspend, terminate, or ban any user at any time for any reason, including but not limited to: violation of these terms, harmful behavior, or at our sole discretion. Upon termination, you lose all access to the server and any purchased items.

13. Governing Law & Dispute Resolution

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall first be attempted to resolve through good-faith negotiation. If unresolved, you agree to submit to the exclusive jurisdiction of courts in the applicable jurisdiction.

14. Changes to Terms

We may update these Terms of Service at any time. Continued use of our server after changes constitutes acceptance of the new terms. The "Last updated" date reflects the most recent revision.
